Pineda <br />Director <br />The Division has received and reviewed BRL's 3rd Quarter 2013 Pond Inspection Reports for the <br />Bowie No. 2 Mine. The inspections were conducted in compliance with Rule 4.05.9(17) and the <br />reports were submitted in a timely manner. No potential hazards were identified in the <br />reports. <br />The "Status During Inspection" section of the report includes (second line) a "Sediment (% <br />remaining)" observation. The observations recorded do not appear to be consistent with <br />recent observations by the Division. For instance, Ponds C and F are reported to have 90% <br />remaining, but visual observations by the Division indicate that the ponds are nearing the <br />required cleanout level. Pond K is reported to have 80% remaining capacity, which is consistent <br />with Division observations. It appears that the values for Pond C and F may have been <br />incorrectly reported. Please review the Sediment capacity section of the report and either <br />verify the reported values or provide a revised report. <br />If you have any questions or need additional information, please contact me. <br />Sincerely, <br />Susan L.
