As of October 17, 2013, the objections are resolved, and the previously <br />requested hearing is cancelled. The following permit page edits are requested to clarify details <br />associated with the objection resolution. Upon receipt of adequate page edits, the Technical <br />Revision No. 39 will be considered final and issued. <br />On October 7, 2013, and in response to comments and objections received following the <br />Division's Proposed Decision to Approve Technical Revision No. 39, Energy Fuels Coal, Inc. <br />submitted a revised page, 2.04.10 -5, retaining the previously approved Ponderosa- Pinyon- <br />Juniper reference area (Plot B), as well as incorporating the new Pinyon- Juniper reference area. <br />The previously approved grassland reference area (Plot A) remains unaffected by this revision. <br />The previously approved Ponderosa - Pinyon- Juniper reference area is generally northwest facing. <br />The proposed Pinyon- Juniper reference area is generally east and southeast facing. EFCI <br />proposes to combine data from both woodland reference areas and the respective vegetation <br />sample data. <br />EFCI proposes, "Combining the two reference areas also offers a larger area of reference for <br />comparison of the reclamation success criteria. TR39 is amended to combine the vegetation <br />sample data of both reference areas as one study unit." <br />The Division believes that utilization of both the Ponderosa - Pinyon- Juniper (Plot B) reference <br />area and the proposed Pinyon- Juniper reference area addresses concerns raised by both groups of <br />landowners of the portal area property. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
