PERMIT #: M- 2006 -017 <br />INSPECTOR'S INITIALS: TC 1 <br />INSPECTION DATE: October 8, 2013 <br />OBSERVATIONS <br />This inspection was initiated by a request for a Surety Reduction (SR) the Division received on August 5, 2013 <br />from the Operator, Premier Silica LLC. Premier Silica LLC was represented during the inspection by Mr. <br />James Barnes. The Jemadojin Sand Mine site entrance is one mile north of Myers Road on Dearing Road about 30 <br />miles southeast of Colorado Springs in El Paso County. <br />According to Mr. Barnes, this mine has been a source for filter sand. The Operator has recently been getting <br />their sand from a site closer to their processing plant in Colorado Springs. The site was not active at the time of <br />the inspection, nor had it been for quite some time. <br />Inspection: <br />Permit Boundary: A permit sign was displayed at the site entrance (see Photo 1). Some excavation limit <br />boundary markers were observed. Access is controlled by a locked gate (see Photo 2). The site perimeter was <br />driven with Mr. Barnes. <br />Reclamation Success: <br />The pit wall appears to have been graded to a slope approximating 4H:1 V or flatter (see Photo 3). The pit floor <br />is graded to drain towards the west and no standing water was observed (see Photo 4). The diversion ditch on <br />the north end of the site shows signs of near adequate revegetation. Reject material from previous screening on <br />site is stockpiled just downgradient (southeast) of the diversion ditch. The reject pile appeared to be stable. <br />Records: <br />• The total permitted area is 299.78 acres. The August 28, 2013 approval of TR -01 reduced the maximum <br />allowed disturbed area from 34 to 10 acres. <br />• The previous inspection was performed on 2/7/13. No problems were noted. <br />• The 2013 Annual Report was submitted on May 17, 2013. However, no Annual Fee was provided. This <br />is cited as a Problem on page 1 of this report. The required map submitted with the 2013 Annual <br />Report appears to have been for the processing plant in Colorado Springs. The Division needs the map <br />for the mine site. <br />• The post -mine land use is rangeland. <br />Current Stipulations: <br />None. <br />Bond: <br />The current financial warranty is a $243,500.00 corporate surety. The purpose of this inspection was to <br />determine if the bond could be reduced to $64,439.00. Based on this inspection, the Division recommends the <br />bond be reduced to $64,439.00. However, the bond reduction cannot occur until the required Annual Fee is <br />received. <br />Summary and Recommendations: <br />1. The Division is required to approve a surety reduction request within 30 days of the surety related <br />inspection, or deny the request within 60 days of the surety related inspection. <br />2. The OPERATOR is in arrears with respect to the $791.00 Annual Fee. The Division cannot approve the <br />current Surety Reduction (SR -01) until Annual Fees are current. The OPERATOR must submit the <br />required Annual Fee before November 8, 2013 in order for the surety reduction to be approved. <br />3.
