The Division of Reclamation, Mining and Safety, in accordance with Title 34, Article 33, of the
Colorado Revised Statutes, hereby issues notice that on September 26, 2013, a minor revision
application (MR -22) to the Peabody Sage Creek Mine, Permit No. C- 2009 -087, operated by Peabody
Sage Creek Mining, LLC, P.O. Box 250, Hayden, CO 81639 -0250 was considered complete for the
purposes of filing. A solar powered microwave tower is proposed to be erected in order to link
communication infrastructure with the Peabody Sage Creek Mine and the Foidel Creek Mine. The
proposed microwave tower is outside of the approved disturbance and will be classified as a Small Area
Exemption. The Total disturbance proposed is 0.01 acres. All reviews and comment periods as
provided in the Act and Regulations promulgated thereunder initiate from this date of filing.
