10/16/13 State.co.us Executive Branch Mail - Fwd: COG850064
To: Jim Kiger <Jim.Kiger€ oxbow.com>
Cc: Kelly Morgan - CDPHE <ke11y.morgan@state.co.us>
Mr. Kiger,
Upon review, we recognize that the chronic WET test failed at outfall 015X, as reported on the
Second Quarter DMR. We have received your letter dated July 16th, 2013 acknowledging the test
failure and alkalinity issues. We further recognize the failure to follow up the WET test failure with
the automatic compliance response, as outlined in the permit.
We are also in receipt of your letter dated September 24th, 2013, stating that as of September
10th, 2013, the pumps were shut down, are on standby, and there is a chance that the discharge is
complete. If pumping is resumed from the well, our expectation is that you move forward with the
accelerated WET testing procedure.
Also, if you anticipate an ongoing need for discharge from 0015X, we recommend obtaining an
individual permit for this outfall. An individual permit would provide more WET testing options, such
as your individual permit C00000132.
If you have any questions, please feel free to contact me.
Thank you!
Brock Bowles
Environmental Protection Specialist
Colorado Division of Reclamation, Mining and Safety
https: / /mail.g oog le.conVmai I /u /0 / ?ui =2 &i Ire29129fcb5 &viev-- pt &search =i nbox&th =141 bddcc52cO7cO2 2/3
