The Operator shall CEASE AND DESIST all activities at the site, with the <br />exception of activities, as approved by the Division in writing, that are necessary to <br />prevent damage to off -site areas or to protect health and safety until the Operator <br />complies the conditions of this Order. <br />The Board REVOKES permit number M -2000 -067. <br />The Board finds that the financial warranty, number 7655 -5821, for permit <br />number M- 2000 -067 is subject to forfeiture. The Board directs the Division to <br />schedule a hearing for the forfeiture of the current financial warranty after all <br />parties have been properly noticed. <br />The Board imposes a CIVIL PENALTY for 33 days of violation at $100 per <br />day for a total civil penalty of $3,300. The civil penalty shall be due and payable <br />within thirty (30) days of the effective date of this Order. Failure to submit the <br />unsuspended portion of the entire civil penalty by the date specified above shall <br />result in immediate submittal of such unsuspended penalties to state collections. <br />DONE AND ORDERED this W Xay of _ 2013. <br />FOR THE COLORADO MINED LAND <br />RECLAMATION BOARD <br />Thomas E. Any party adversely affected or <br />aggrieved by agency action may commence an action for judicial review by filing a <br />notice of appeal with the district court within thirty -five (35) days after the effective <br />date of this order, pursuant to section 24 -4 -106, C.R.S. (2013).
