The Division received EFCI's responses to our <br />midterm review on August 1, 2013. <br />Please see the list of issues below. The numbers refer to the numbers in our original review <br />(February 20, 2013). The items in bold type still need to be resolved. I recognize that EFCI is <br />working on some of these issues, but I want to document that they have not yet been resolved. <br />1. Resolved. <br />2. Please provide state well permit information in accordance with Rule 2.03.10. All <br />monitoring wells are required to be permitted with Colorado Division of Water <br />Resources; State Engineer's Office. Please provide DWR -SEO permit information <br />for all monitoring wells approved in the permit. <br />3. Resolved. <br />4. Resolved. <br />5. Resolved. <br />6. Resolved. <br />7. The Division has been notified of several structures that may have been affected by <br />subsidence; 3 fence corners that have pulled out of the ground and possible damage to <br />a historic cinder block barn. The Division requires EFCI to verify impacts to these <br />structures and conduct mitigation efforts in accordance with Rule 4.20.3, and permit <br />section 4.20.3, if determined that these impacts are a result of EFCI's mining activities. <br />(EFCI indicated that they are looking into surveying this and other issues with The Corley <br />Company.
