Thank you \ery much for your reply. Your suggestion to implement an indefinite extension is appreciated and
appropriate.
We will proceed with an indefinite extension, upon receipt of concurrence with the concept from EFCI.

The Corley Company accepts your suggestion for a postponement of the Oct. 16th Board hearing for TR39. We do not
know if it is procedurally correct to ask for an indefinite postponement instead of specifying a December hearing date in
order to avoid additional postponements if the possible resolution is making progress to completion.

Thank you all for your ongoing efforts to resolve the pending issues related to the EFCI Technical Revision No.
39. DRMS is interested in facilitating a resolution acceptable to everyone. It is our hope that an agreement can
be achieved without involving the Mined Land Reclamation Board or the extensive resources that will be
expended by all parties if a hearing becomes necessary.
