October 7, 2013 <br />Ms. Janet Binns — Reclamation Specialist <br />Colorado Division of Reclamation Mining & Safety <br />1313 Sherman St — Room 215 <br />Denver, CO 80203 <br />RE: Technical Revision No.39 (TR -39) - Additional Information and Amendment Request <br />Energy Fuels Coal, Inc. (EFCI) — Permit No. C -81 -014 — Southfield Mine <br />Dear Janet Binns: <br />Pursuant to the submittal of Technical Revision No.39 (TR -39), submitted during May, 2011, <br />further evaluation of TR -39 found that due to landowner concerns pertaining to slope aspect for <br />comparison of the Reference Areas as they relate to The Corley Company's reclaimed parcel of property <br />situate at the eastern portion of the Mine Portals Area, EFCI requests that TR -39 be amended to combine <br />both Reference Areas, the Reference Area Plot "B" and the Proposed Reference Area and to include the <br />respective vegetation sample data for the Southfield revegetaion evaluation. <br />Reference Area Plot "B" has a slope aspect of a northwesterly direction which offers a closer likeness for <br />comparison of slopes on the Corley reclaimed parcel of property. <br />The "Proposed" Reference Area offers slope aspects in an easterly direction and a southerly direction <br />which are comparable to the Vento reclaimed parcel of property at the Mine Portal Area. Combining the <br />two RA's also offers a larger area of reference for comparison of the reclamation success criteria. <br />Accordingly, EFCI respectfully requests the Division to withhold their current Proposed Decision to <br />approve TR -39 and to amend TR -39 to combine the RA Plot "B" with the Proposed RA to evaluate the <br />revegetation success at Southfield. <br />If you have questions or require further information, please contact me. <br />Sincerely, <br />George V Patterson <br />Energy Fuels Coal, Inc <br />Enclosure: Replacement page 2.04.10 -5.
