Summary <br /> <br />The Review Process <br /> <br />Twentymile Coal (TC), a subsidiary of Peabody Investments Corporation, submitted a permit <br />renewal application (RN-06) for the Foidel Creek Mine. The Foidel Creek Mine is exclusively <br />an underground coal mining operation located approximately 22 miles southwest of Steamboat <br />Springs, Colorado in Routt County. Permit No. C-82-056 was issued on May 23, 1983, and has <br />been renewed every five years since that date. <br /> <br />For the current renewal RN-06, the Division notified TC by letter on August 20, 2012 that its <br />permit for the Foidel Creek Mine would expire on May 23, 2013. The letter explained that, for <br />operations to continue beyond that date, Section 2.08.5(3)(f) requires an application for renewal <br />to be received on or before November 24, 2012. TC submitted a renewal application on <br />November 19, 2012 and the application was found complete on November 23, 2012. TC <br />published a notice of the application in the Steamboat Pilot, four consecutive weeks from <br />December 2, 2012 through December 23, 2012. <br /> <br />No objections regarding the application were received. <br /> <br />The applicant violator system (AVS) was queried on January 16, 2013 and the recommendation <br />of the system was to provide ownership and control updates. A follow-up AVS query was <br />conducted on August 13, 2013 and the recommendation of the system was to provide additional <br />ownership and control updates. A follow-up AVS query on September 4, 2013 resulted in a <br />recommendation to issue this renewal. <br /> <br />On January 21, 2013, the Division sent an adequacy letter to TC requesting additional <br />information with regards to portions of the permit. TC provided responses to the Division’s <br />adequacy letter in a letter dated July 12, 2013 and received by the Division on July 16, 2013. <br />The Division sent a second adequacy letter to TC requesting additional information with regards <br />to portions of the permit on August 13, 2013. TC provided responses to the Division’s adequacy <br />letter in a letter dated August 28, 2013 and received by the Division on August 30, 2013. The <br />Division updated the Reclamation Cost Estimate on January 30, 2013 and again on August 14, <br />2013, incorporating responses from TC. All adequacy concerns have been resolved; therefore, <br />the Division proposes to approve the renewal application. <br /> <br />Publication of this proposed decision initiates a thirty-day public comment period.
