PERMIT #: M -1974 -092 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: October 3, 2013 <br />On October 8, 2013, the Division received a notification from the Colorado Department of Public <br />Health and Environment's ( CDPHE) Environmental Release and Incident Report System for the Barlow <br />Mine. The report stated that a 2,000 gallon fuel tank had overturned during the flood event and <br />released approximately 500 gallons of fuel. The Division was unaware of the fuel release during the site <br />visit on October 3, 2013. Mining at the Barlow Pit is conducted by the Lyman- Ritchie Corporation. The <br />Division spoke with Gene Reeser of Lyman- Ritchie, who stated that the fuel tank was carried into the <br />pit during the flood. When the flood waters receded, the fuel tank was found in the pit upside down <br />and empty. The fuel which was in the tank was released into the flood waters and was discharged from <br />the site. The tank was retrieved from the pit once the flood waters receded. <br />Rule 3.1.13 of the Construction Materials Rules requires Operators to notify the Division of a spill of <br />any toxic or hazardous substance, including spills of petroleum products, which occur within the mined <br />land permit area. Any time a spill occurs the Operator shall: <br />1) Within 24 hours of the time the spill is reported to any other agencies with jurisdiction over the spill, <br />notify the Division via phone, facsimile, or email. <br />2) Include in the notice any relevant information known at the time contact is made with the office in <br />assessing spill seriousness, such as: <br />a) Operation name; DRMS permit number and name of person reporting the spill. <br />b) Telephone number of a responsible company official for the Division staff to use as a contact. <br />c) Date and time of spill. <br />d) Type of material spilled (CAS number if applicable, from the material safety data sheet form) <br />e) Estimate of the amount spilled, whether any material has left the permit area, and where the <br />spilled material went. <br />f) Initial measures taken to contain and clean up spill <br />As noted earlier in this report, the CDPHE was notified of the spill. However, the Operator failed to <br />comply with Rule 3.1.13. This has been cited as a problem and will require corrective action by the <br />Operator; please see the first page of this report for additional information. Given the magnitude and <br />rarity of the storm event, the Division will not require the Operator to perform any mitigation related <br />to the release of the fuel. <br />This concluded the inspection. <br />Page 3 of 5 <br />
