II. Support Facilities - Rule 4.04

Support facilities are discussed on pages 2.05-17.1 to 2.05-65.5.6a of Volume I and is
also discussed on pages 2.05-4 to 2.05-6 of Volume II, Maps 15 of Volume IX and
Maps 24 and 26 of Volume V-A.

The Division finds the support facilities in compliance with Rule 4.04.

III. Hydrologic Balance - Rule 4.05

A.Water Quality Standards and Effluent Limitations

1.The Division proposes to grant small area exemptions from use of
sedimentation ponds due to the limited size of the areas and due to the fact that
ponds and treatment facilities are not necessary for the drainage to meet the
effluent limitations of Rule 4.05.2 and applicable State and Federal water
quality standards for receiving streams and also due to the fact that no mixing
of surface drainage with a discharge from underground workings will occur.
Discussions of the approved alternate sediment control locations are located
on pages 2.05-82 through 2.05-84.7 in the permit application. No new
alternative sediment control areas are proposed or approved with this permit
renewal.

B. Surface and Ground Water Monitoring

l. The applicant will conduct monitoring of ground water in a manner approved
by the Division. The ground water monitoring plan can be found in Exhibit
14, Volume II-B of the permit application (4.05.l3(l)).

2.The applicant will conduct monitoring of surface water in a manner approved
by the Division. The monitoring plan was submitted under 2.05.6(3)(b)(iv)
and can be found in Exhibit 14, Volume II-B of the permit application
(4.05.l3(2)). NPDES monitoring is conducted under permits CO-0027154
(surface facilities area), CO-0042161 (Fish Creek Borehole), CO-0036684
(Fish Creek Tipple), COG-850051 (18RT), COG-00850054(6MN sediment
pond).

3.The following wells serve as the Foidel Creek Mine’s ground water points of
compliance: 97013TM (Twentymile Sandstone), 008-77-58 (Wadge
overburden), 008-AU3 (Fish Creek alluvium), 008-AT-1 (Trout Creek
alluvium), and 008-AV-2 (Foidel Creek alluvium.)

The Division has reviewed the surface and ground water monitoring plans as part
of the renewal process. These monitoring plans are adequate to monitor for the
development of impacts, if any should develop (4.05.13(2)).
