Pineda <br /> <br />Director <br />Re: Southfield Mine (Permit No. C-1981-014) <br /> Proposed Decision - Technical Revision No. 40 (TR-40) <br /> Energy Fuels requests removal of monitoring well MW-NW from the approved water <br />monitoring program. <br /> <br />Dear Ms. Gallagher: <br /> <br />The Division of Reclamation, Mining and Safety has made a Proposed Decision for Technical Revision No. 40 <br />at the Southfield Mine. The Division took into account concerns you had identified in a letter to the Division <br />received on September 3, 2013. Your concerns were forwarded to the Division’s hydrogeologist and evaluated <br />in his review. <br /> <br />TR40 proposed to eliminate monitoring of Southfield’s monitoring well MW-NW. The Division finds that <br />elimination of monitoring MW-NW still allows Energy Fuels Coal Inc.’s ground water monitoring program to <br />meet the requirements of Rule 4.05.13 (1)(a) and (c), and 4.05.13(3). <br /> <br />Concerns you had identified regarding flow in Newlin Creek have previously been addressed in a Division <br />memo titled, “Groundwater Review related to Citizen Complaint” dated June 3, 2013, available on the <br />Division’s laserfiche database and sent to you on June 16, 2013. You had also included concerns related to <br />vegetation establishment on the reclaimed mine site. TR40 is specific to cessation of water monitoring of <br />MW-NW. Vegetation concerns are not relevant to TR40. <br /> <br />Your letter also included references to Federal lands in Wyoming. The Southfield Mine is subject to the <br />Colorado Surface Coal Mining Act and Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining. <br /> <br />Notice of the proposed decision will be published in the Cañon City Daily Record as soon as possible.
