<br />TINS ASSIGNMENT, dated effective as of the 25th day of November, 1997 (the "Eff`ective
<br />Date ") between WESTERN AGGREGATES, INC., a Delaware corporation (the "Assignor ") and
<br />TEXAS INDUSTRIES, INC. a Delaware corporation (the "Assignee "), witnesseth that:
<br />WHEREAS, Assignor holds certain rights and obligations under the following Agreements

<br />lessee, by virtue of the assignment thereof from Cliffs Engineering, Inc. to L.C.
<br />Holdings, Inc. on December 9, 1987 and from L.C. Holdings, Inc. to Assignor on
<br />September 29, 1998;"
