16. The Division contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />January 23, 2013, MINREC, Inc., the operator was current in the payment of reclamation <br />fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(o)). A final check is <br />required before a proposed decision is issued; however, the Office of Surface Mining, <br />Reclamation Fees Branch is not available at this time. The Division will propose its <br />decision to approve the renewal with Stipulation No. 10 that requires a second AVS <br />review to be performed when the system is back online. <br /> <br />Section B - Rule 4 <br /> <br />I. Roads - Rule 4.03 <br /> <br />All roads have been reclaimed except for those approved for permanent retention in <br />support of approved postmining land uses. Respective land owners requested all such <br />retentions in writing. <br /> <br /> <br />A.The Division approved the retention of the haul road depicted on Map No. D-2-3 <br />(loadout area) of the PAP (Rule 4.031(1)(f)). <br /> <br /> <br />B.The Division approved the retention of the access road depicted on Map No. D-3-2 <br />(North Thompson Creek Mines Land Use Map) of the PAP (Rule 4.031(1)(f)). <br /> <br /> <br />C.The Division approved the retention of the Stoney Ridge Fan Shaft Road depicted <br />on Drawing D-3-1of the PAP, including the bridge over North Thompson Creek, <br />as a trail (Rule 4.03.3(7)(a)). <br /> <br />II. Hydrologic Balance - Rule 4.05 <br /> <br /> <br />A.Water Quality Standards and Effluent Limitations <br /> <br />The Colorado Water Quality Control Commission has assigned classifications to <br />the main stem of Thompson Creek and its tributaries. Thompson Creek is <br />described from the headwaters to the confluence with the Crystal River. <br />Tributaries include North, Middle and South Thompson Creeks. The classification <br />is Aquatic Life Cold 1, Recreation 2, Water Supply and Agriculture. Receiving <br />Stream Standards have been established by the Colorado Department of Public <br />Health and Environment (CDPHE). <br /> <br />The No. 1 and No. 3 mine drainages are combined and discharged at CDPS <br />discharge point 001 within the mine site. In April 2006, The Colorado Department <br />of Public Health and Environment – Water Quality Control Division (WQCD) <br />terminated the Colorado Discharge Permit No. CO-0029599. It was later <br />determined that this permit was incorrectly terminated. A new permit, CO- <br />048233, was issued for the North Thompson Creek Mine on February 1, 2010. <br /> <br />WQCD inspected the North Thompson Creek Mine on April 26, 2013. WQCD <br />noted that the treated water meets the effluent standards and the landowner/water <br /> <br /> <br />12 <br /> <br />
