1041%c <br />M3 coalN Conwany Seneca Coal Company <br />September 30, 2013 <br />Ms. Janet Binns <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80202 <br />RE: Seneca II -W Mine (Permit C -82 -057) <br />TR -81, Bond Reduction Request <br />Ms. Binns, <br />RECE�vE� <br />Seneca Coal Company (SCC) is submitting Technical Revision No. 81 (TR -81) to formally <br />request a bond reduction based on the Division's Midterm Permit Review (MT6). <br />The Division calculated a new reclamation cost estimate taking into account the remaining tasks <br />to be completed that have not been released through the phased bond release process and the <br />tasks removed due to approval of PR6. The Division estimated the reclamation cost to be <br />$5,818,456.00 which is $437,096.61 less than the current bond held. In accordance with Rule <br />3.02.2(5) "A permittee may request reduction of the required performance bond amount upon <br />submission of evidence to the Division proving to the Division that the permittee's method of <br />operation or other circumstances will reduce the maximum estimated cost to the Division to <br />complete the reclamation responsibilities and therefore warrant a reduction of the bond amount." <br />SCC is referencing the Division's new bond estimate as evidence that the reduction in the bond <br />amount to $5,818,456.00 is warranted. <br />If there any questions please contact me at (970) 276 -5217. <br />Sincerely, <br />Roy A.
