M- 1979 -089. <br />The 23 Road Pit is claimed to be a pond in existence prior to January 1, 1981.The operator has <br />requested a partial reclamation responsibility release for the area. A review of records with the <br />Division of Water Resources reveals no prior permitting history for this site. In accordance with <br />Section 37- 90- 137(11)(b), C.R.S., areas exposing ground water prior to January 1, 1981 do not <br />require a well permit, plan for augmentation, or plan of substitute supply to replace depletions from <br />evaporation. Data available at the time of the review reveals the existence of a pond at the site as far <br />back as 1993. The applicant should provide supporting information, such as dated aerial <br />photographs, to support his claim that the pond was in existence prior to January 1, 1981. There <br />should also not be any enlarging of the existing pond without prior approval by the Division of Water <br />Resources. <br />While it seems possible that the pond was inexistence prior to January 1, 1981, the applicant should <br />provide supporting documentation to confirm these claims.
