RECEIVED <br />Resolution: SEP '13 /'Oi3 <br />Division of reclamation, <br />NATURE OF VIOLATION: Mining & Safety <br />This item is in regard to a Notice of a Possible Violation, corrective actions and civil penalties for a <br />possible violation of C.R.S. §34- 32.5 -101 et se q., and specifically C.R.S § 34- 32.5- 109(1) for failure to first <br />obtain a reclamation permit from the Mined Land Reclamation Board before engaging in a new mining <br />operation. <br />CHRONOLOGY: <br />June 20, 2013 - The Division of Reclamation, Mining and Safety (Division /DRMS) conducted normal <br />monitoring inspection of the site. The Division cited as a problem incorrect placement of boundary <br />markers. <br />July 19, 2013 - The Division conducted follow up inspection of the site to verify the location of the <br />markers. During the inspection it was found that an area of approximately 14.5 acres had been affected <br />by the mining operation; this is 4.5 acres more that what is currently approved in the permit.
