Stover & Associates on behalf of <br />Bowie Resources, LLC (BRL) to the Division's adequacy review comments regarding the technical revision <br />application (TR -81) submitted for the Bowie No. 2 Mine. The revision proposes drainage and postmining <br />topography changes on Gob Pile #2 and the enlargement of Pond F. With the exceptions noted below, <br />all of our concerns have been adequately addressed. <br />1. DRMS: The Table of Contents for Volume IX was last updated with PR -12 in November 2010. <br />The page numbers listed are largely outdated, Figure 4 is not listed, and the list of Stability <br />Analyses does not include the Buckhorn studies for TR -75, TR -76 and TR- 81.Please update the <br />Table of Contents for Volume IX. <br />BRL: Please see Page x, the revised Table of Contents for Volume IX. <br />DRMS: The revised page content is adequate, but the page number at the bottom of the page <br />appears to be incorrect. The currently approved version of the Table of Contents shows Volume <br />IX on page xiii. Please revise the page number of the Table of Contents for Volume IX to be <br />consistent with the currently approved permit application package. <br />6. DRMS: Revised page 10 of Volume IX indicates that Pond F will be cleaned when sediment <br />accumulation reaches 75% of the maximum storage, but further states that the ability to <br />remove sediment from pond F is contingent upon weather conditions. Two years of sediment <br />capacity and scheduled cleanouts at 75% capacity are recognized as best practices, and the <br />Division understands that weather conditions are a valid concern for maintenance scheduling. <br />BRL can determine how best to schedule sediment removal from the pond, as long as BRL <br />ensures that the pond is in compliance with Rule 4.05.6(3)(b) requiring that ponds provide for <br />adequate sediment storage volume and periodic sediment removal to effect compliance with <br />appropriate discharge effluent limits.
