Mining & Safety <br />Response to September 19, 2013 Adequcy Letter 2. <br />Dear Mr. Bowles, <br />The purpose of this letter is to respond to the Division's September 19, 2013 PAR #2 for <br />Technical Revision No. 75 to the Oxbow Mining LLC (OMLLC) Permit No. C- 1981 -022. The <br />Division's comments are in bold followed by Oxbow's response. <br />Item #1. The dimensions of the proposed pad were described in an email sent by OMLLC <br />on Sept. 18, 2013. The pad will have "a top dimension of approximately a 130'x25' finished <br />pad area on a 25' high fill" and will consist of 2,000 cy of fill. The proposed location of this <br />pad is between the hillside, a road and railroad. It is unclear to the Division how a pad this <br />large will fit in the proposed location. Please submit design plans for the pad to clarify its <br />construction and for calculating the cost estimate. Also, submit a description of the pad, its <br />purpose and dimensions for insertion into Section 2.05.3 of the permit. <br />Oxbow Response: The Map 2.05 -M1, Sheet 2 of 6 already shows the NFEI.LC pad area fitting <br />quite nicely. A modified page 2.05 -23e is attached providing additional details regarding the pad. <br />Item #3. A storm water sediment control plan needs to be submitted to address the <br />standards of Rule 4.05.5 for the proposed degas pad. <br />Oxbow Response: Per Rule 1.04(132)(a), the Division's Rules at 4.05.5 do not apply to gas <br />projects. Nevertheless, as we noted in the original July 12, 2013 Application, NFELLC's <br />stormwater sediment control will be accomplished by seeding slopes, installation of hay bales, <br />straw wattles and /or other BMP stormwatcr controls. <br />Item #4. In the September 18, 2013 email sent by OMLLC, it stated that 2,000 cy of soil will <br />be used as fill for the degas pad and the material will be obtained from a road slide along <br />the back entrance road. It is unclear from the email the location of the borrow area. <br />Please describe in further detail the location of the borrow area and include a map for <br />• Page t <br />
