PERMIT #: M- 1984 -013 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: August 22, 2013 <br />CORRECTIVE ACTIONS: The operator shall conduct a survey and replace the boundary markers in the correct <br />location(s). The operator shall provide proof to the Division that this has been done by the corrective action <br />date. <br />CORRECTIVE ACTION DUE DATE: 10/31/13 <br />OBSERVATIONS <br />The site was inspected by Michael Cunningham of the Division of Reclamation, Mining and Safety (Division). <br />Mr. George Otten, the Permittee, was not present for the inspection. The Mackey Mine is accessed by <br />travelling 2 miles north from Blackhawk on HWY 119, turning left on Apex Valley Rd., and then left on Forest <br />Service Rd. 4. The site is permitted for 0.35 acres and the post- mining land use is forestry. <br />The Mackey Mine is a 110(2) hard rock underground mine. The mine is currently in temporary cessation and <br />was not operating at the time of the inspection. The first five year term of temporary cessation will end on <br />March 8, 2016. <br />During the Division's last inspection conducted on July 27, 2010, the Division cited the following problems <br />which have yet to be resolved: <br />1) The affected area was not clearly delineated by monuments or markers. <br />2) The adit portal was not safeguarded. <br />3) Substantial refuse and damaged equipment was scattered throughout the site. <br />4) The financial warranty amount of $1,000 is not adequate to complete reclamation at the site. <br />The permit sign was posted at the site entrance as required by Rule 3.1.12. However, the boundary of the <br />affected area was not delineated. The Division observed conditions similar to what was observed during the <br />last inspection. There is still a substantial amount of refuse that needs to be removed from the site including <br />steel tanks, generators, and other miscellaneous equipment. As required by Rule 3.1.5(5), all refuse shall be <br />handled and disposed of in a manner that will control unsightliness. <br />The adit was closed at the time of the inspection; it was covered with two ply wood panels, secured with a 2x4 <br />nailed across both of the panels. In addition, some waste rock was piled at the bottom of the closure. The <br />closure is not very secure can be easily removed with hand tools. The existing closure is not adequate to keep <br />people from entering the mine during the period of temporary cessation. The adit should, at the very least <br />have a steel lock or a more permanent closure while the site is not in operation. <br />The Division currently holds a financial warranty in the amount of $1,000.00. The Division mailed a notice of <br />financial warranty increase to the Permittee on August 31, 2010. The Division determined that the financial <br />warranty needed to be increased to $8,162.000; the financial warranty increase was to be submitted to the <br />Division within sixty days of the notice. The Division did not receive the increased financial warranty. As a <br />result, the Division has recalculated the required financial warranty amount which must be posted with the <br />Division. Notice of the financial warranty increase will be sent under separate cover. <br />The Division has cited several problems which have been outstanding since the last inspection in 2010. The <br />Operator should carefully review the first page of this report for the required corrective actions and associated <br />corrective action timeframes.
