S U Npt' GAP ......., c,Q �¢ �OTAR j.. , :C 9. .,•mac oF��.OQ;.; NOTICE OF PROPOSED DECISION The Colorado Division of Recla- mation, Mining and Safety has is- sued a proposed decision to Bond Release Application No. 4 (SL -04) for the West Elk Mine, Permit No. C- 1980 -007. The Underground operation is operated by Moun- tain Coal Company, LLC under the provisions of the Colorado Surface Coal Mining Reclamation Act of 1979. The Partial Phase 11 Bond Release application was submitted by Mountain Coal Company, LLC on October 3, 2011. The proposed Partial Phase II Bond Release is for 67.6 acres for the successful replacement of topsoil and the es- tablishment of vegetation to con- trol erosion to levels at or below the premining levels. The Partial Phase II Bond release areas were reclaimed between 1996 and 2008 and include the done Pine Gulch fa- cilities area, the 2000 thermal event area and methane drainage well pads and roads from nine different drilling areas. More detailed infor- mation regarding the release areas can be found in the SL -04 applica- tion, on file at the Division's Denver office. The Division is proposing to release $196,037.00. The affected area is located in Delta and Gun- nison Counties, approximately 9 miles East of Paonia, Colorado. Any person who has an interest which is or may be adversely af- fected may request an adjudicatory hearing regarding this proposed decision.
