Pineda <br />Director <br />The Division has completed a preliminary adequacy review of the technical revision application <br />(TR -82) submitted by Bowie Resources, LLC (BRL) for the Bowie No. 2 Mine. The revision <br />proposes to update the BRL ownership and control information in the permit application <br />package. We have the following comments and questions regarding the application. <br />1. The sixth line of revised page 2.03 -2 indicates that ownership and control information <br />for Cedars Energy, LLC is presented on page 2.03 -24. This sentence should reference <br />ownership and control information for Bowie Resources Holdings, LLC, since Cedars <br />Energy is no longer the immediate owner of BRL. Please revise page 2.03 -2 to <br />reference Bowie Resources Holdings, LLC instead of Cedars Energy, LLC. <br />2. The eighth line of revised page 2.03 -2 indicates that the corporate structure is shown on <br />page 2.03 -32; in the proposed revised pages, the structure diagram is shown on page <br />2.03 -34. Please correct the corporate structure page location reference on page 2.03- <br />2. <br />3. Paragraph (d) on revised page 2.03 -2 states that BRL controls the Bowie No. 1 Mine. <br />Please revise the text to indicate, in addition to the Bowie No. 2 Mine, BRL also <br />controls the Bowie No. 1 Mine. <br />4. The last sentence of revised page 2.03 -2, following the Bowie No. 1 Mine information, <br />indicates that BRL and /or its owners and controllers "do not own or control any surface <br />coal mining operation in any state in the United States ". It appears that BRL should <br />state that "That the applicant... does not own or control any other surface coal mining <br />operation..." Please verify the statement on page 2.03 -5 under 2.03.4(4)(a -b) and <br />revise as necessary. <br />5.
