Box 483 <br />Paonia, CO 81428 <br /> <br />Re: Bowie No. 2 Mine (Permit No. C-1996-083) <br /> July 2013 NPDES Discharge Monitoring Reports <br /> <br />Dear Mr. Bear: <br /> <br />The Division has received and reviewed Bowie Resources, LLC‘s (BRL) July 2013 Discharge <br />Monitoring Reports (DMR) for the Bowie No. 2 Mine. BRL submits the DMRs to the Division <br />monthly in accordance with Rule 4.05.13(2). The discharges reported for the ponds and sewage <br />treatment plant were consistent with Division observations of water levels and discharges. <br /> <br />As indicated in BRL’s cover letter to the Water Quality Control Division, the limits of the <br />approved discharge permit were exceeded. The primary Total Suspended Solids limit (70 mg/l) <br />was exceeded at Outfalls 001, 002, 003, and 007. The currently approved NPDES permit for the <br />Bowie No. 2 Mine allows for a waiver for the Total Suspended Solids limit in the event of a <br />storm in excess of the 10 yr - 24 hour event, subject to the burden of proof requirements <br />outlined in the permit. BRL indicated that the mine area had experienced a 2.16 inch rain fall <br />event; the 10 yr – 24 hr, 25 yr – 24 hr, and 100 yr – 24 hr events for the area are 1.8”, 2.1”, and <br />2.6” respectively. The waiver applies an alternate standard of 0.5 ml/l for settleable solids. The <br />alternate Settleable Solids limit was exceeded at Outfall 002. <br /> <br />The Division does not have any questions or comments at this time. We will continue to <br />monitor the maintenance and performance of the sediment ponds at the site.
