Exhibit Page 23
conditions, open water is not expected to remain in these basins for long periods of time,
and water - loving species of plants will colonize these areas.
3. Other items may include berms and swales /ditches for storm water control and wind shelter,
to be determined at the time of reclamation release of individual areas (and not to be done if
there is a bond revocation action).
As mining progresses, areas mined the previous year will already be backfilled and graded, with
soil placed and seeded, at the end of the next year. Seeding will be done at the proper season
based on recommendations (See Map, Exhibit F, and Exhibit J).
Items specified for the Reclamation Plan in Rule 6.4.5.(1) and 6.4.5.(2)f. have been included in
other items in this Exhibit or have been included in other Exhibits referenced above, and
therefore are not separately listed in this exhibit.
Although the Operator commits to no more than 900 feet of highwall at any time (of which 150
feet will be the responsibility of Montezuma County to reduce), and highwalls are to be limited to
1:1 or flatter slopes internally, the Operator reserves the right to have vertical highwalls of up to
300 feet long and 25 feet high, for brief periods, in that maximum of 900 linear feet.
