Exhibit Page 20 <br />bedrock, overburden may be placed to serve as subsoil (goal 1.5 feet thick) and graded smoothly. Some low <br />overburden berms may be left in place and covered with soil after grading to blend with the surroundings, to <br />control storm water and improve grassland, and provide shelter for livestock. <br />Backfilling (3.1.5(2)) <br />As much as possible, soil and overburden removed to mine gravel will be used immediately for backfill and <br />replacement of soil. Otherwise, soil and overburden will be separated and placed in berms or stockpiles. If <br />stored, excess materials will also be placed in stockpiles before using to backfill. Overburden and excess <br />materials will be used for backfill as the initial step in reclamation, to create stable slopes, cover shale <br />overburden, and provide smoother terrain suited for grazing. This will include filling ravines to smooth the south <br />slope of the mesa. Backfilling depth will range from 0 -30 feet, but expected to average 2 feet. See cross - <br />sections, Exhibit E -1. If backfilling is done in areas that are not actually mined, vegetation and sufficient soil to <br />replace soil on the backfilled area will be removed prior to backfilling. <br />Grading to control erosion, siltation and prevent damage (3.1.5(3)) <br />Grading will be done so that erosion and sediment is controlled on affected lands and so that there is no damage <br />to areas outside those. All vertical highwalls (mining faces) will be eliminated, and final slopes will be below the <br />angle of repose to prevent potential slides or other damage on affected lands or outside the permit boundary. <br />Temporary grading, including berms, rock check dams, swales, etc. may be incorporated during mining and <br />reclamation as necessary. As much as possible, there will be no discharge from disturbed areas, and if there is <br />discharge, will be through sediment basins (detention ponds) or other permanent controls. <br />Performance as soon as feasible (3.1.5(4)) <br />For most of the affected area, the time between initial disturbance and completion of reclamation work7 will be <br />one to three years, with a goal of one year (except for seeding, see Exhibit J). The old 110 permit affected lands <br />(See Exhibit S) and some temporary roads will not be fully reclaimed until near the end of the life of the mine. <br />Roads and roadside areas outside the block being mined will be at final grade and surface within 1 -2 years of <br />first disturbance but may not have release requested until later, if temporary or because of maintenance. Some <br />previously mined blocks that will have a part used for temporary road access may have reclamation delayed until <br />later.$ Backfilling and grading will be done quickly but placement of soil may wait until use of the area for access, <br />stockpiling, and temporary storm water control ceases. <br />Refuse and acid - forming or toxic producing materials (3.1.5(5)) <br />No acid - forming or toxic producing materials are anticipated to be exposed, mined, or processed at this site. <br />Any excess materials after crushing and screening, including product not processed or sold at the time of <br />closure, will be incorporated into backfill, except for any stockpile of material left for landowner use after <br />reclamation and release. Fuels, lubricants, raw materials (AC oil, Portland cement, admixtures, etc.) and other <br />chemicals necessary for the operation and maintenance of plants, equipment and trucks will be located in the <br />work area with suitable spill /leak protection and reporting. <br />Holes, etc. (3.1.5(6)) <br />There are no drill holes, auger holes, adits or shafts to reclaim. <br />Maximum slopes (3.1.5(7)) <br />All areas, including basins, former headwalls, and berms, shall have slopes not exceeding 2H:1 V. Slopes as <br />proposed are compatible with surrounding conditions and land use. <br />Use of farm equipment (3.1.5(8)) <br />As pasture/ grazing land, there is no use of farm equipment anticipated, but slopes will be compatible with <br />equipment use in the area, such as mowing, seeding, or weed control. <br />Notice of other backfill (3.1.5(9)) <br />The Applicant will comply with this requirement to notify the Division if other backfill is used. The Applicant <br />expects some use of excavated clean overburden and soil from project sites supported by this operation to be <br />used for backfill or soil placement, and agrees to comply with requirements current at the time of use. <br />Prevention of unauthorized release of pollutants to surface water (3.1.5(10)) <br />7 Grading, placement of soil, seeding and related activities: time necessary for seeded areas to have <br />sufficient vegetation for reclamation release varies significantly and can take from two to ten years. <br />8 This will not be necessary until after year 8, since the road access for blocks H5 -N5 and N3 will be a <br />permanent road. <br />
