Hickenlooper
Governor
Mike King
Executive Director
Loretta Pineda
Director
The Division of Reclamation, Mining and Safety (Division) received Oxbow Mining LLC's
( OMLLC) response to the adequacy questions for Technical Revision No. 75 (TR -75) at the Elk
Creek Mine on September 4, 2013. The Division has the following additional comments and
questions regarding the proposed plan:
1. The dimensions of the proposed pad were described in an email sent by OMLLC on Sept.
18, 2013. The pad will have "a top dimension of approximately a 130'x25' finished pad
area on a 25' high fill" and will consist of 2,000 cy of fill. The proposed location of this
pad is between the hillside, a road and railroad. It is unclear to the Division how a pad
this large will fit in the proposed location. Please submit design plans for the pad to
clarify its construction and for calculating the cost estimate. Also, submit a description of
the pad, its purpose and dimensions for insertion into Section 2.05.3 of the permit.
2. OMLLC has committed to submitting the COGCC permit when issued for incorporation
into the permit.
3. A storm water sediment control plan needs to be submitted to address the standards of
Rule 4.05.5 for the proposed degas pad.
4. In the September 18, 2013 email sent by OMLLC, it stated that 2,000 cy of soil will be
used as fill for the degas pad and the material will be obtained from a road slide along the
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
