Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) has completed its adequacy review of the above <br />referenced permit application.. The application was received on August 27, 2013 and was called complete on <br />September 3, 2013. All comment and review periods began on September 3, 2013. The decision date for this <br />application is October 3, 2013. Please be advised that if you are unable to satisfactorily address any <br />concerns identified in this review before the decision date, the Division will deny this application. <br />The review consisted of comparing the application content with specific requirements of Rules 1.4.4, 6.1, 6.2, 6.3, <br />and 6.5 of the Minerals Rules and Regulations of the Colorado Mined Land Reclamation Board for Hard Rock, <br />Metal, and Designated Mining Operations. The application was substantially adequate, however, as with most <br />applications there are a few items that will require the submittal of additional information or clarification of the <br />existing information. Inadequacies are identified under the respective exhibit heading along with suggested <br />corrective actions to correct them. <br />Application Form <br />1. As required by Rule 1.6.2(1)(g), please provide proof that the public notice required by 1.6.3 was published. <br />2. As required by Rule 1.6.2(1)(g), please provide the proof that the notices required by 1.6.2(1)(e)(i) and (ii) <br />were sent to the Owners of Record. This requirement would be satisfied by submitting copies of certified <br />mail receipts or proof of personal service (Rule 1.4.1(4)). <br />3. If mining activities will be conducted each year, but mining will be conducted for less than 180 days in each <br />year, the permit application must contain a statement that the operation is an intermittent operation in order <br />to avoid a temperoary cessation notice (C.R.S. 34- 32- 103(6)(a)(II)). Please provide the following statement <br />if applicable: "Mining activities will occur for less than 180 days per year on affected land ". <br />6.3.1 Exhibit A — Legal Description and Location Map <br />4. Per Rule 6.3.1(3) please include the surface owners of record for the public lands south of the claim. <br />6.3.2 Exhibit B — Site Description <br />5. Please provide a description of the vegetation and soil characteristics per Rule 6.3.2(a).
