III. COMMENTS -COMPLIANCE <br />Eagle Mines C- 1981 -044 <br />21 May 2008 <br />cow <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Eagle Mines conducted by Jim Stark of <br />CDRMS. Jerry Nettleton of BTU- Empire and Roy Kara of Peabody accompanied me <br />on the inspection. The mine is currently in temporary cessation and is only performing <br />maintenance and monitoring activities. The inspection was conducted on 21 May <br />2008. The weather was warm and sunny and the ground was mostly dry. A few <br />areas of the mine were flooded from the spring run -off in the Williams Fork and <br />Yampa Rivers. <br />Availability of Records: All of the necessary records were available. The records were <br />brought to the inspection in a box by Jerry Nettleton. Please see the DRMS <br />Availability of Records form at the end of this inspection for more detailed <br />information. <br />Signs and Markers: - All of the necessary signs were in place as required. The <br />entrances along Colorado Highway 13 all have their appropriate signs. Stream buffer <br />zone (and buffer zone exemption) signs were also in place as required. <br />Roads: - The mine access road was dry and in good condition. The road is well <br />maintained and appeared stable at the time of the inspection. There were no <br />erosional problems noted on the road at the time of the inspection. <br />- The access roads on the east side of the mine were all dry. All of the roads were <br />well maintained and appeared to be stable at the time of the inspection. <br />- The operator graded and seeded a ranch road that goes to the top of the ridge on <br />the west side of the mine above the backfilled #4 Mine portals. The road appeared <br />to be stable and in good condition. <br />Hydrologic Balance: - The Mine 5 dewatering ponds, 5 -P5, 5 -P6 and 5 -P7, all <br />contained water and were all stable and well vegetated at the time of the <br />inspection. The ponds were discharging into the Williams Fork at a rate of <br />approximately 5 GPM and the discharge looked clear (although some water from <br />the river was backed up into the outfall area of the pond). There did not appear to <br />be any muskrat holes or erosional problems in the pond embankments at the time of <br />the inspection. <br />- Sediment Ponds 9 -P7 and 9 -P8, by the old B &S building, were both dry at the time <br />of the inspection.
