Notification of Intent to Seek Bond Release
Mr. Nettleton:
The Division has reviewed Moffat County Mining, LLC's (MCM) proposed Notification of Intent to Seek Bond Release
and have the following comments:
•
Asper Rule 3.03.2(1)(b), please include in the proposed Notification of Intent to Seek Bond Release the number
of acres of land for which the bond release is sought for in the Williams Fork Mines' permit area.
Multiple individuals or entities were listed in MCM's proposed public notification as surface or mineral rights and
interest within or adjacent to the Mine Permit Boundary but were not listed in the submitted Bond Release Notice
Mailing List. Will all individuals and entities on MCM's proposed public notification be receiving a letter of
notification for intent to seek bond release or just individuals and entities included on the mailing list? The
following names were included in MCM's Notification of Intent to Seek Bond Release Proposed Public Notice
and not the Bond Release Notice Mailing List:
1. Martin, Willa Dean (Mabel Birch et. al.)
2. Mitchell, James J. and Kathleen C. (Mabel Birch et. al.)
3. Purdy, Patricia A.
The Division reviewed the proposed Williams Fork Mines Bond Release Notice Mailing List for surface owners
within and adjacent to the permit area. When compared to Map 1 — Surface Owners, there appears to be
individuals either left out of the mailing list or are either no longer surface owners. The following surface owners
were noted on Map 1 — Surface Owners but not listed within the proposed Williams Fork Mines Bond Release
Notice Mailing List:
1. Mitchell, James
2. Fedge, Norman and Caro
The Division would like to know if these are no longer surface owners within or adjacent to the permit area. If the
above mentioned individuals are still surface owners within or adjacent to the permit area, please include them to
the proposed Williams Fork Mines Bond Release Notice Mailing List.
The Division reviewed the proposed Williams Fork Mines Bond Release Notice Mailing List for mineral rights
and interest within or adjacent to the permit area. When compared to Map 2 — Coal Ownership, there appears to
be individuals and entities left out of the mailing list or no longer have coal ownership. The following coal owners
were noted on Map 2 — Coal Ownership but not listed within the proposed Williams Fork Mines Bond Release
Notice Mailing List:
1. Bennet and Rossomondo
2. Pulsen, Edna and Vantassel, Florrence
3. Easum, Thomas (et. al.)
