APPROVAL CRITERIA FOR BOND RELEASE <br />Phase I Bond Release <br />Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released <br />when the permittee successfully completes backfilling, regrading, and drainage control in <br />accordance with the approved reclamation plan." No previous Phase I bond release applications <br />have been approved for this mine site. <br />The SL -01 application requests partial Phase I release for 14.3 acres of land reclaimed between <br />2009 and 2012. The requested areas are associated with the CYCC Office building constructed <br />in 1967 and demolished in 2006, the Eastern Mining District/9 -Right Ventilation Shaft <br />Installation, 18 -Right Intake Shaft Installation, and the Fish Creek Tipple Facilities and an <br />associated soil stockpile. <br />IV. OBSERVATIONS AND FINDINGS <br />The bond release inspection for this bond release application (SL -01) was conducted on May <br />29, 2013. During the inspection, the majority of the areas associated with SL -01 were observed <br />to allow for visual assessment of compliance with pertinent requirements. Geo- rectified maps <br />and GPS were utilized to verify location of permanent features and to record field data relevant <br />to specific site locations. In addition, relevant documentation developed over the life of the <br />operation, including information from operator annual reports and prior Division inspection <br />reports, has also been utilized in the compliance evaluation. Such documentation is referenced <br />in this section as appropriate. <br />In order to determine compliance with Foidel Creek Mine's backfilling and grading plan to <br />meet the approximate original contour for SL -01, locations were plotted along the center of <br />the Fish Creek Tipple Pad, the EMD Pad, and the 19 -Right Pad to create an on the ground <br />cross - section of each location. The points were collected to determine the elevation as <br />compared to elevation information approved in the Foidel Creek Mine Permit for each <br />applicable area. The points collected at the site were downloaded from the Trimble into <br />Pathfinder office and converted into a point shapefile to utilize in ArcGIS. The cross <br />sections collected were compared with the approved post mining topography of the areas <br />requested for bond release. <br />Elevation data obtained by using the Trimble Yuma are not exact. The Geoid used in the <br />Trimble GeoXT is DMA 10X10 Global, which is a global elevation Geoid and not as <br />accurate as a localized Geoid. For this reason a known point was collected within the Foidel <br />Creek Mine permit to determine a correction factor for the elevation collected in the Trimble <br />Yuma. The elevation at the known survey point was 6971.32' on the Trimble Yuma utilizing <br />a projected coordinate system; UTM, NAD 83, Zone 13 North compared to 6976.22' with <br />Foidel Creek Mine Page 4 September 11, 2013 <br />Phase I Bond Release <br />
