Executive Director <br />PO Box 806 Loretta Pineda <br />Director <br />Salt Lake City, Colorado 84110 <br />Re: Camp Bird Mine, Permit M -1982 -090, Notice of Pending Designation as a Designated Mining <br />Operation <br />Dear Mr. Butters, <br />As a result of a review of the present and foreseen operational conditions of the Camp Bird Mine, <br />including site geology and geochemistry, potential ore materials to be extracted, the chemicals and <br />reagents that will be necessary to use for water treatment, and other pertinent permit file documents, <br />the Division has determined that the Camp Bird Mine, permit no. M- 1982 -090 is a Designated Mining <br />Operation (DMO). This determination is made in conformance with provisions of the Rules and <br />Regulations of Hard Rock, Metal, and Designated Mining Operations ( "Rules "), and applicable sections of <br />the Colorado Mined Land Reclamation Act (C.R.S. §§ 34- 32- 101,et seq.) ( "Act "). <br />Rule 7.2.2(1) provides that the Division may notify an Operator of the Division's determination that an <br />existing or proposed mining operation is, or has reasonable potential to be, a DMO. <br />Rule 7.2.1(1) and §103(3.5)(a) of the Act state that the Division's determination of a DMO will be based <br />on criteria described in the definition of a DMO, found in Rule 1.1(14). <br />Pursuant to Rule 7.2.2(2) the Division is required to accompany the Notice of DMO determination by the <br />factual statements used in the determination. <br />The Act and Rules define a Designated Mining Operation to be a mining operation at which acid- or <br />toxic - forming materials will be exposed or disturbed as a result of mining operations. Therefore, the <br />specific criteria used by the Division to determine that this operation is a DMO based upon the exposure <br />of acid- or toxic - forming materials are the following: <br />1. Activities at the Camp Bird Mine currently consist of rehabilitation of the main portal toward the <br />existing underground workings. Proposed mining operations have the potential to affect the <br />hydrological balance both in quality and quantity. In order to continue to proceed toward <br />potential mining reasonably anticipated activities will include dewatering, water treatment, and <br />discharge. A water treatment facility will utilize chemicals, which may be toxic or acidic, and <br />must provide proper containment; the treatment plant must be considered an Environmental <br />Protection Facility (EPF) and addressed through an Environmental Protection Plan (EPP). <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Duranoo Ar:tivp and lnnntivp Minpc <br />
