On October 23, the <br />Federal Judge issued a temporary restraining order but on October 30, denied the <br />plaintiff's motion for a preliminary injunction. <br /> <br />The judge essentially held that the plaintiffs were not entitled to an injunction <br />for lack of proof that anyone would be immediately injured if the new criteria <br />took effect. <br /> <br />The lawsuit itself remains lodged in the court, attacking the legality of the new <br />regulations. It is likely to be several months or more before the matter C03eS <br />to trial. Additional plaintiffs have joined in the suit. <br /> <br />Meanwhile, the new oriteria are in force as of October 30_ <br />
