This opinion is <br />provided to you as the lead Federal Agency regarding section 7 consultation on <br />this project. <br /> <br />This biological opinion has been reviewed by and prepared in cooperation with <br />our Albuquerque, New Mexico, Ecological Services Office in Region 2. While <br />the actual water depletions occur in San Juan, Hinsdale, Mineral, Archuleta, <br />La Plata, and Montezuma Counties, Colorado, the associated impact to <br />endangered fishes occurs in the San Juan River in southwest Colorado, New <br />Mexico, and Utah. The San Juan River is covered under the "Recovery <br />Implementation Program for the San Juan River" (U.S, Fish and Wildlife Service' <br />1992) for which Region 2 has the lead. This bioloQical opinion is consist~nt <br />with th~ Proqram a9reements administered by Reaion 2. <br /> <br />Reference is made to your September, 25, 1995, correspondence requesting <br />initiation of formal consultation for water depletion impacts on the San Juan <br />National Forest within the San Juan River Basin. The Service concurs with <br />your "no effect" determinations for water depletion impacts to the peregrine <br />falcon (Falco oereqrinus), bald eagle (Haliaeetus leucoceohalus), Mexican <br />spotted owl (Strix occidentalis lucida), southwestern willow flycatcher ~ <br />(Emoidonax traillii extimus), and Uncompahgre fritillary butterfly (Boloria ~~ <br />acrocnema) for the amount of water depletion specified in your programmatic <br />biological assessment. If modifications to existing projects are planned and <br />proposed proJects described in the programmatic biological assessment have <br />other impacts besides water depletion impacts to the above species, those <br />impacts should be assessed and the Service should be contacted for informal <br />consultation. <br /> <br />Projects within the Mancos River drainage and drainages to the east (upstream) <br />of the Mancos River confluence with the San Juan River that annually deplete <br />
