ROBERT OWEN <br />COLORADO WATER CONSERVATION BOARD <br /> <br />December 1974 <br /> <br />The National Wild and Scenic Rivers Act (P.L. 90-542) enacted by Congress <br /> <br />in October 1968 declares in its first section that it is the policy of the United <br /> <br />States to protect,in their free flowing condition,certain selected rivers and <br /> <br />their immediate enviromnents which ..."possess outstandingly remarkable scenic, <br /> <br />recreational, geologic, fish and wildlife, historic, cultural or other similar <br /> <br />values," for the benefit of present and future generations. That section also <br /> <br />provides the machinery to implement the policy by instituting a National Wild <br /> <br />and Scenic River System, designating the initial components in the system, and <br /> <br />prescribing the methods by which other components: may be added from time to time <br /> <br />to the system. <br /> <br />Rivers included in the system are authorized by Act of Congress in Section <br /> <br />2(a)(i) or by an act of the legislature of the state or states through which the <br /> <br />rivers flow. Rivers included in the national system through a state act must <br /> <br />be accepted by the Secretary of Interior as meeting the criteria for wild and <br /> <br />scenic rivers established by the Act, and administered by the state or political <br /> <br />subdivision of the state without expense to the United States. Section 2(b) <br /> <br />states that a wild, scenic, or recreational river must be a free flowing stream <br /> <br />and possess one or more of the values in Section 1 to be eligible for inclusion <br /> <br />~ <br />
