<br />THIS AMENDMENT, made this '6isr day of May 1999, by and between the State
<br />of Colorado for the use and benefit of the Department of Natural Resources, Colorado Water
<br />Conservation Board (CWCB), hereinafter referred to as the STATE, and the SOUTHEASTERN
<br />COLORADO WATER AND STORAGE NEEDS ASSESSMENT ENTERPRISE, P,O. Box 440, Pueblo, CO
<br />81002, hereinafter referred to as the CONTRAcroR.
<br />
<br />FACTUAL RECITALS
<br />
<br />A. Authority exists in the law, and funds have been budgeted, appropriated, and otherwise made
<br />available and a sufficient unencumbered bCllance thereof remains available for payment in
<br />Fund Number 424, Appropriation Code SEV, Contract Encumbrance Number C153754,
<br />
<br />B, Required approval, clearance, and coordirlation has been accomplished from and with
<br />appropriate agencies.
<br />
<br />C, The STATE and the CONTRACTOR entered into a contract dated May 29, 1997, Contract
<br />Encumbrance Number C153754, hereinafter referred to as the ORIGINAL CONTRACT and
<br />incorporated herein by reference, wherein the STATE agreed to participate in the Arkansas
<br />River Basin/SECWCD Water and Storage Needs Assessment (hereinafter referred to as
<br />ASSESSMENT) by contributing $75,000 toward the costs of Phase I of the ASSESSMENT.
<br />
<br />D, The CONTRACTOR has completed Phase I of the ASSESSMENT, which resulted in twelve
<br />-recommendations conceming future' water supply and storage needs of ASSESSMENT
<br />participants. The CONTRACTOR will further antllyze and study the Phase I recommendations in
<br />Phase II of the ASSESSMENT, The CONTRACTOR has requested the STATE to participate in
<br />Phase II of the ASSESSMENT by contributing $25,000 toward the costs of Phase II.
<br />
<br />E, Pursuant to Senate Bill 98-1401, Section 3(d), the STATE is authorized to fund water resource
<br />planning at the local level in an amount of up to $275,000 from the Severance Tax Trust Fund
<br />Operational Account (STTFOA) created by 9 39-29-109(1)(a),
<br />
<br />F. At its January 27-28, 1999 meeting, the CWCB approved the CONTRACTOR'S request for
<br />CWCB participation in Phase II of the ASSESSMENT by contributing $25,000 toward the costs
<br />of Phase II. The CWCB directed staff to contribute the $25,000 from the FY99 STTFOA if
<br />sufficient funds were made available in that account due to reprogramming of those funds, To
<br />address the possibility that such funds may not become available in that account, the CWCB
<br />also directed staff to seek authorization in the 1999 Construction Fund Bill to expend $25,000
<br />as a cost-sharing participant in the ASSESSMENT,
<br />
<br />G, At its May 24-25, 1999 meeting, the CWCB approved the reprogramming of funds in the FY99
<br />STTFOA to make $25,000 available for Phase II.
<br />
<br />H. Because the FY99 STTFOA contains the necessary funds for the CWCB's participation in
<br />Phase II of the ASSESSMENT, the STATE and the CONTRACTOR have agreed to amend this
<br />
