CONTRACTOR: BROOK FOReST WATER DISTRICT Ccntract No. C153379 Agency Name: Water Ccnservation Board Agency Number PDA Rcuting Number: 03 PDA 007)70 Con t r act Arne n d men t No. 3 THIS AMENDMENT, made this February 1, 2003, by and between the State cf Cclcradc for the use and benefit cf the Department cf Natural Resources, Ccloradc Water Conservaticn Board, hereinafter referred to as the CWCB and/cr STATE, and the Brook Forest Water District, 32471 Lodgepcle Drive, Evergreen, CO 80439, hereinafter referred to as the CONTRACTOR. Factual Recitals A. Authority exists in the law, and funds have been budgeted, appropriated, and otherwise made available fer payment in Contract Encumbrance Number C153379. B. Required approval, clearance, and cocrdination have been accomplished from and with appropriate agencies. C. The CWCS and the CONTRACTOR entered 'Into a contract dated April 1, 1982, amended on Ncvember 15, 1982 and December 6, 1983, Ccntract Encumbrance Number C153379, hereinafter referred tc as ORIGINAL CONTRACT, incorporated herein by reference, wherein the CWCS agreed tc lean money in the total amount of $124,707, and the CONTRACTOR agreed tc repay the loan in accordance with the terms cf the Original Contract. D. As collateral for the loan, the CONTRACTOR conveyed fee title to certain real property to the CWCB by a warranty deed dated July 7, 1983 and a Conveyance of Utility Lines and Facilities dated July 7, 1983, E, The CONTRACTOR requested the CWCB to convey fee title to the collateral back to the CONTRACTOR in exchange for a deed cf trust executed by the CONTRACTOR conveying a security interest in the collateral tc the CWCB. F, The current practice of the cwes \s to take a security interest in the collateral through a deed cf trust. G.
