CONTRACT AMENDMENT No. 1 This Amendment, made this May 1, 2002, by and between the State of Colorado for the use and benefit of the Department of Natural Resources, Colorado Water Conservation Board, hereinafter referred to as the CWCB or STATE, and Clifton Gunderson LLP, a Colorado Limited Partnership, hereinafter referred to as the CONTRACTOR. Factual Recitals A. Authority exists in the law, and funds have been budgeted, appropriated, and otherwise made available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 424, Appropriation Code AFR, Contract Encumbrance Number C150053A. B. Required approval, clearance, and coordination have been accomplished from and with appropriate agencies. C, The STATE and the CONTRACTOR entered into a contract C150053 dated November 24, 2000, and a novation agreement dated December 3, 2001, ("Original Contract") for performance audits of the loan programs, A copy of the Original Contract is incorporated herein by reference, D, The parties entered into the Original Contract in the amount of $70,920 to perform the duties, pursuant to Contractor's successful bid on the Request for Proposal RFP PDA-134W-CPA, issued August 20,2000. E. The Length of Contract provided in the RFP was from the date the contract was signed or November 6, 2000, whichever was later, to June 30, 2002, and the CWCB reserved the right to extend the contract if project conditions necessitate. F. The CWCB requested the CONTRACTOR to provide the same services as described in the RFP for three additional fiscal years, for a total time for performance of five years.
