WHEREAS. required apPnlv~nce and coordinalion has been accomplished from and with lIppropriale

WHEREAS~ a conttact and a contract amendment were entered
into on January 5. 1987, and on October 1. 1987. respectively.
Contract Encumbrance Number C-153484 (the Original Contract and
the First Amendment)'. between the State and the Contractor~
w~ich by their termS are still in effect; and

WHEREAS~ the Contractor has performed wor~ pursuant to the
Original Contract and to the First Amendment as part of the
feasibility report; and

WHEREAS. to dat~ the State has paid to the Contractor
Sixty-Eight Thousan~ Four Hundred Dollars ($68,400) of the
total of Seventy-TwO Thousand Dollars ($72.000) required of the
Original Contract afid the First Amendment; and

WHEREAS. the fe~sibility report in the Original Contract
was designed to respond to all concerns expressed by COlorado
water interests in the Upper Rio Grande Basin of the State of
Colorado: and

WHEREAS. the State had to review the feasibility report
assumptions in regard to all provisions of the Rio Grande
Compact; and

WHEREAS~ the State also had to review the feasibility
repo~t assumptions in regard to the future operation of the
Closed Basin Project~ which is a project funded mainly by the
Federal Government (U.S. Bureau of Reclamati6n); and

WHEREAS~ during the performance of the Contractor's work~
pUblic meetings were held concerning the feasipility report for
this project; and

WHEREAS~ statements made at the public meetings indicated
that the Plan of Study outlined in Exhibit A ot the Original
Contract needed to include additional alternatives and/or to
address 'additional concerns; and

.W~REAS. after the above reviews and public meetin9s~ it
was d~cided by the state in December. -1987~ in consultation
with the Contractor. that additional alternatives should be
developed and analyzed so that a more complete picture of~the
proposed pro ject could be formed; and

WHEREAS~ because of the necessity of the a~ove reviews and
the time required to perform the reviews. and because of the
decisions to develop other a1ternatives~ the Skate. through the
Director "of the Colorado Water Conservation BOilrd. and the
Contractor verbally agreed~ prior to January 1, 1988. that the
Co~tractor could not furnish a" final repo~t to the State by
