CONTRACT

THIS CONTRACT, made this fl.ih. day of JIlo~eM.\.ty 2000, by and between the
State of Colorado for the use and benefit of the Department of Natural Resources, Colorado
Water Conservation Board, hereinafter referred to as the CWCB and/or STATE, and the Pikes
Peak Area Council of Governments, a regional planning agency, 15 South 7''' Street, Colorado
Springs, Colorado 80905, hereinafter referred to as the CONTRACTOR.

FACTUAL RECITALS

A. Authority exists in the law, and funds have been budgeted, appropriated and otherNise
made available and a sufficient unencumbered balance thereof remains available for
payment in Fund Number 100 Organization YYYY, Appropriation, GSL PPAC, Program
WTRC, Object Code 5120, Reporting Category 0051, Contract Encumbrance Number
C150051.

8. Required approval, clearance, and coordination have been accomplished from and with
appropriate agencies.

C. Pursuant to Section 39-29-109(1)(a), C.R.S., the State is authorized to fund water resource
planning at the local level from the Operational Account of the Severance Tax Trust Fund.

D. The CONTRACTOR is a regional planning agency, formed pursuanf to Article 28 of Title 30
C.R.S. and is comprised of several local governments from the Pikes Peak region,
including the Soards of County Commissioners of El Paso and Teller Counties.

E. At its July 2000 and September 2000 meetings, the CWCS approved a grant at up to
$50,000 from the Severance Tax Trust Fund Operational Account to the CONTRACTOR for
the full cost of completing the Fountain Creek GIS Study ("PROJECT").

F. The purpose of the PROJECT is to create a GIS database for the Fountain Creek
Watershed. The database will facilitate planning and management of watershed mitigation
strategies based on various flood and erosion scenarios found within the watershed.

G. The CONTRACTOR has selected U.R.S. ("CONSULTANT") to conduct the work in accordance
with the scope of work prepared by the CONTRACTOR and the CONSULTANT, and approved
by the CWCS.

NOW THEREFORE, in consideration of the mutual and dependent covenants contained
herein, the parties agree as follows:

1. Preparation of Scope of Work. The CONTRACTOR shall perform the tasks in accordance
with the Scope of Work attached as Appendix A and incorporated herein.
