<br />AGENCY NAME; Water Conservation Board <br />AGENCY NUMBER: POA <br />ROUTING NUMBER: 01 PDfj 00029 <br /> <br />$ 50,000 <br /> <br />CONTRACT <br /> <br />THIS CONTRACT, made this fl.ih. day of JIlo~eM.\.ty 2000, by and between the <br />State of Colorado for the use and benefit of the Department of Natural Resources, Colorado <br />Water Conservation Board, hereinafter referred to as the CWCB and/or STATE, and the Pikes <br />Peak Area Council of Governments, a regional planning agency, 15 South 7''' Street, Colorado <br />Springs, Colorado 80905, hereinafter referred to as the CONTRACTOR. <br /> <br />FACTUAL RECITALS <br /> <br />A. Authority exists in the law, and funds have been budgeted, appropriated and otherNise <br />made available and a sufficient unencumbered balance thereof remains available for <br />payment in Fund Number 100 Organization YYYY, Appropriation, GSL PPAC, Program <br />WTRC, Object Code 5120, Reporting Category 0051, Contract Encumbrance Number <br />C150051. <br /> <br />8. Required approval, clearance, and coordination have been accomplished from and with <br />appropriate agencies. <br /> <br />C. Pursuant to Section 39-29-109(1)(a), C.R.S., the State is authorized to fund water resource <br />planning at the local level from the Operational Account of the Severance Tax Trust Fund. <br /> <br />D. The CONTRACTOR is a regional planning agency, formed pursuanf to Article 28 of Title 30 <br />C.R.S. and is comprised of several local governments from the Pikes Peak region, <br />including the Soards of County Commissioners of El Paso and Teller Counties. <br /> <br />E. At its July 2000 and September 2000 meetings, the CWCS approved a grant at up to <br />$50,000 from the Severance Tax Trust Fund Operational Account to the CONTRACTOR for <br />the full cost of completing the Fountain Creek GIS Study ("PROJECT"). <br /> <br />F. The purpose of the PROJECT is to create a GIS database for the Fountain Creek <br />Watershed. The database will facilitate planning and management of watershed mitigation <br />strategies based on various flood and erosion scenarios found within the watershed. <br /> <br />G. The CONTRACTOR has selected U.R.S. ("CONSULTANT") to conduct the work in accordance <br />with the scope of work prepared by the CONTRACTOR and the CONSULTANT, and approved <br />by the CWCS. <br /> <br />NOW THEREFORE, in consideration of the mutual and dependent covenants contained <br />herein, the parties agree as follows: <br /> <br />1. Preparation of Scope of Work. The CONTRACTOR shall perform the tasks in accordance <br />with the Scope of Work attached as Appendix A and incorporated herein. <br /> <br />Page' of 6 <br />
