<br />.WHEREAS. required arrroval, clearance and coordination .has been accomplished from and with appropriate

<br />WHEREAS, 'J the Governor of the State of Colorado declared
<br />that an emergency disaster existed in the State of Colorado
<br />under Proclamation of May 29, 1981, which state of disaster was
<br />renewed on June 26, 1981; and
<br />
<br />WHEREAS, by Executive Order dated May 29, 1981, and
<br />renewed on June 26, 1981, the Governor suspended the
<br />operation of regulatory statutes, rules, regulations, and
<br />orders relating to the implementation of procedures developed
<br />by the Division of Disaster Emergency Services for disbursing
<br />monies for repairs to Horse Creek Dam on Horse Creek located in
<br />Adams and Weld Counties and In particular, CRS 1973, 37-60-121,
<br />122, and 123, as amended, whIch relate to the Colorddo Water
<br />Conservdtion BOdrd Construction Fund, dnd CRS 1973, 24-30-202,
<br />as amended, together with all rules, regulations, and orders
<br />promulgated thereunder whicll relate to fiscai procedures for
<br />execution of contracts by tile Slate; and
<br />
<br />WHEREAS, irrigation systems in Larimer, Weld, Logan,
<br />Morgan, Sedgwick, and Washington Counties dre In immediate need
<br />of repair j dnd
<br />
<br />WHEREAS, pursuant to the Disdster Emergency Proclamations
<br />and Directives of the Division of Disdster Emergency Services
<br />issued thereunder, the office of ti,e Director of the Colorado
<br />Water Conservation Board is to repair Horse Creek Dam on Horse
<br />Creek, located within the State disaster declared counties
<br />requiring emergency dction to restore essential services
<br />provided by these quasi pubLic carriers dS rapidly dS possible;

<br />WHEREAS, It is agreed that funds are available In the
<br />Colorado Wdter ConservatLon BOdrd Construction Fund for the
<br />r~palr of Horse Creek Dam; and
<br />
<br />WHEREAS, the guideLines for assistance in the conservation
<br />and utLLizatio,\ of CoLorado's wdler resources through the
<br />Colorado Water ConservatIon Board Construction Fund will be
<br />used to process dppLicdtiol\5 frolo (Iitch company applicdnts; dnd

<br />WHEREAS, the Contrdctor is a duly constituted and
<br />organized irrigdtion district in the Stale of Colorado and
<br /><i[lre"!s'to lJndflrtdke the rep<ilr, repLacement, or reconstruction

<br />Colorado, d principal component of the irrigation system owned
