<br />
<br />1, Authority exists in the law, and funds have been budgeted, appropriated, and otherwise made available and
<br />a sufficient unencumbered balance thereof remains availal:lle for payment in Fund Number 424, Appropriation Code
<br />362, Contract Encumbrance Number C153633; and
<br />
<br />2, Required approval, c1e~rance"and coordination has been accomplished from and with ap~ropriate agencies;

<br />3, The STATE and'the CONTRACTOR entered in~a cot1tractdated November 19, 1992, Contract Routing Number
<br />93314, Contract Encumbrance Number C153633hereiMfter referred to as ORIGINAL CONTRACT, wherein the STATE
<br />agreed to loan money in the total amount of $250, 00 ($2:30,000 for project construction and $20,000 for feasibility
<br />report contract) to the CONTRACTOR to be used for enlargement and rehabilitation of Hourglass Dam and the CONTRACTOR
<br />agreed to repay the loan in accordance with the terms of the ORIGINAL CONTRACT; and

<br />
<br />4, Paragraph A,2 of the ORIGINAL CONTRACT states that the completion date of the PROJECT is to be within two
<br />and one-half (2 1/2) years from the date pf the ORIGINALCof'lTRACT unless extended by the STATE due. to circumstances
<br />beyond thecontr'!l of the CONTRAcrOR;and'

<br />5.. COrilTRA~TOR has supplied a IEme'r dated March 7, 1995, attached hereto as ATTACHMENT A and made a
<br />part hereof"requesting ari'extension for the date of completion, and explaining the need and reason for the extension;

<br />6, The STATE has reviewed the situation and is satisfied that the CONTRACTOR'S need for an extension of one
<br />and one-half (1 1/2) years is reasonable and necessary; and
<br />
<br />7. The STATE and the CONTRACTOR agree to extend the time for completion of the ORIGINAL CONTRACT by one
<br />and one-half (1 1/2) years to November 19, 1996,
<br />
<br />NOW THEREFORE, it is hereby agreed that
<br />
<br />,,1, Consideration for this Amendment to the ORIGINAL CONTRACT consists of the payments which shall be made
<br />pursuant to this Amendment and ORIGINAL CONTRACT and tne promises and agreements herein set forth,
<br />
<br />2, It is expressly agreed by the parties that this Amendment is supplemental to the ORIGINAL CONTRACT which
<br />is made a part hereof, and identified as ATTACHMENT 8 and all terms, conditions, and provisions thereof, unless
<br />specifically modified herein, are to apply to this Ame'ndment as though they were expressly rewritten, incorporated,
<br />and included herein,

<br />3, It is agreed the ORIGINAL CONTRACT is and shall be modified, altered, and changed to read as follows:

<br />a. Paragraph 8,2: Contract for the construction of said PROJECT to responsible and capable firms, hereinafter
<br />referred to as CONSTRUCTION FIRMS, which CONSTRUCTION FIRMS shall be selected through competitive public
<br />bidding, said PROJECT to be completed within four (4) years of the date of this contract' (by November 19,
