P.O. BOX l30, Norwood, CO 81423. <br />hereinafter referred to as the Contractor. <br /> <br />WHEREAS. authority exists in the Law and Funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains (9~ payment in fund Number 4008 . <br />G/L Account Number 5287X, Contract Encumbrance Number : and <br />ABL Account Number 12870, Org. Unit 77-77-777, <br />WHEREAS. required approvOII, Clearance and coordination has been accomplished from and with appropriate <br />agencies: and <br /> <br />WHEREAS. pursuant to the provisions of section 37-60-119. <br />Colorado Revised Statutes. as amended. the State is authorized <br />to construct certain water projects for the benefit of the <br />people of the State of Colorado; and <br /> <br />WHEREAS. the San Miguel Water Conservancy District has made <br />application to the State for the improvement of its existing <br />facility. such improvement of the facility is hereinafter <br />sometimes referred to' as the project: and <br /> <br />WHEREAS. the Contractor is a Water Conservancy District <br />within the State of Colorado; <br /> <br />NOW THEREFORE. it is hereby agreed that: <br /> <br />1. The Contractor shall have a feasibility report prepared <br />and directed to the problem of incorporating a pumped storage <br />hydropower project as an element of the ongoing San Miguel <br />feasibility study. in accordance with a proposal for such a <br />report prepared by the consulting engineering firm of Boyle <br />Engineering Corporation (the Consultant) and approved by the <br />State. received June 1. 1987. which proposal is attached hereto <br />as Exhibit A and made a part of this contract. <br /> <br />2. This report will become part of the ongoing San Miguel <br />feasibility report which shall be furnished to the State not <br />later than December 1. 1987. unless such time is extended by <br />mutual agreement of the parties hereto in writing. <br /> <br />3. As compensation for the services of the Contractor. the <br />State shall pay to the Contractor the sum of Eight Thousand <br />Eight Hundred Fifty Dollars ($8,850) in the manner following: <br /> <br />a. Eighty-four percent (84\). to wit. Seven Thousand Four <br />Hundred Thirty-Four Dollars ($7,434) of the total amount <br />due in two (2) monthly installments of Three Thousand Seven <br />Hundred .Seventeen Dollars ($3,717) each, commencing on <br />September 15, 1987. <br /> <br />b. The remaining sixteen percent (16\), to wit, One <br />Thousand Four Hundred Sixteen Dollars ($1.416) within forty <br />(40) days following receipt and acceptance of the written <br />report specif,ied in paragraph 2. of this contract. <br /> <br />4. The totai cost of services to be rendered for the <br />Contractor by the Consultant is Eleven Thousand Eight Hundred <br />Dollars ($11.800) and the Contractor shall pay the sum of Two <br />Thousand Nine Hundred Fifty Dollars ($2.950) as agreed to by <br />letter dated June 1. 1987. which is hereby attached and made a <br />part of this contract as Exhibit B; and in no event shall this <br />payment be the liability of the State of Colorado. <br /> <br />J95-5}(J1-1014 <br /> <br />Page I of ~ pages <br />.(See inSlructiunson reverse of last page.l <br /> <br />3890E <br />
