<br />'!he undersigned water referee, having investigated the matter of the
<br />application on file herein, hereby makes the following ruling thereon.

<br />'!hat the applicant has provided acceptable proof to the court. that the
<br />applicant be, and is hereby, awarded an absolute surface water right to wit:

<br />LOCATION: Legal description of beginning and, end points of. minimum stream flow
<br />claimed: The natural stream channel from headwaters in Section 16,
<br />T. 3 N., R. 84 W., 6th P.M., as the upstream terminus and confluence
<br />with Yampa Rive~ in Section 31, T. 4 N., R. R4 W., 6th P.M., as the
<br />downstream terminus, being a distance of approximately 3.5 miles.
<br />This segment can be located on the Blacktail Mountain, Green Ridge
<br />U.S.G.S. quadrangle.
<br />
<br />Description of ditch and/o~ Pipeline, (Means of Diversion): Not Applicable.
<br />
<br />PRIORITY DATE. September 23, .1977 provided, however, that this right shall be
<br />junior to all priorities awarded in cases filed prior ~o 1977,
<br />and otherwiae junior as provided in C.R.S. 1973, 37-92-306.
<br />
<br />AMOONT OF WATER. Flow in C.F.S.. 1 cfs
<br />
<br />USE OF WATER: To maintain such. .minimum flows as are ~equired to preserve the
<br />natural environment to a reasonable degree, pursuant to C.R.S.
<br />1973, 37-92-103.
<br />
<br />That the Colorado Rlv~r Water Conservation District timely filed a statement
<br />of opposition and subs~quently withdrew said opposition.
<br />
<br />IT IS FURTHER ORDERED that applicant shall install and maintain such water
<br />measurement devices, recording devices, content gauges and inlet and ~utlet
<br />. measurement and recording devices, as the case may be, as are deemed essential
<br />by the Office of the State Engineer, and the same shall be installed and
<br />operated in accordance with instructions from said office.
