<br />This matter has come before the Court on the amended
<br />application of the Colorado Water Conservation Board (the "Boardlt)
<br />and the City of Boulder (ltBoulderlt) for approval of changes of
<br />wat.er rights. The Court, having reviewed the pleadings, the
<br />evidence presented during trial on November 29 and 30, 1993 and
<br />December 1, 2 and 8, 1993, and the stipulations of the parties,
<br />hereby enters the following Findings of Fact, Conclusions of Law,
<br />Judgment and Decree:

<br />FINDINGS OF FACT
<br />
<br />I. GENERAL.
<br />

<br />1.2 The application and the amendment to the application in
<br />this case were filed on December 26, 1990 and May 29, 1992,
<br />respectively. Timely and adequate notice of the application and
<br />the amendment to the application was given as required by law, and
<br />the Court has jurisdiction over the subject matter of this
<br />proceeding and over all parties affected hereby, whether they have
<br />appeared or not. None of the lands or water involved in this case
<br />are within the boundaries of a designated ground water basin.
