<br />FPR 94-372 <br /> <br />e <br /> <br />COLORADO WATER CONSERVATION BOARD <br />721 State Centennial Building <br />1313 SherIDan Street <br />Denver, Colorado 80203 <br /> <br />September 14, 1994 <br /> <br />RESOLUTION <br /> <br />WHEREAS, the USDA Soil Conservation Service completed a floodplain information report <br />entitled "Flood Hazard Analyses, Coal Creek and Rock Creek, Boulder and Weld Counties, Colorado" <br />in October 1976; and <br /> <br />and <br /> <br />WHEREAS, said report includes detailed floodplain information for Coal Creek andRock Creek; <br /> <br />WHEREAS, the Colorado Water Conservation Board, as requested by the Board of County <br />Commissioners of Boulder County, the Board of County Commissioners of Weld County and the Urban <br />Drainage and Flood Control District, by Resolution No. 66, adopted on January 19, 1977, designated <br />and approved the floodplains described in said report; and <br /> <br />e <br /> <br />WHEREAS, a new report entitled "Flood Insurance Study, Town of Superior, Colorado, Boulder <br />County", dated March 1979, has been prepared by the Federal Insurance Administration; and <br /> <br />WHEREAS, said new report includes detailed floodplain information for those portions of the <br />Coal Creek wi1:hin the corporate limits of the ToWll of Superior, as they were in March 1979 ; and <br /> <br />WHEREAS, the detailed information contained in said new report is consistent with the detailed <br />information contained in the report previously designated by Resolution No. 66; and <br /> <br />WHEREAS, the Town of Superior, Colorado, has requested the Colorado Water Conservation <br />Board to designate and approve the floodplains set forth in the aforesaid new report; and <br /> <br />WHEREAS, the Town of Superior, Colorado, has not requested the Colorado Water Conservation <br />Board to rescind any portion of Resolution No. 66; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />e <br />
