NO. 157 <br /> <br />\ <br />, <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 state Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />March 17, 1980 <br /> <br />R E ~ 0 L U T ~ 0 N <br /> <br />WHEREAS, the United States Army Corps of Engineers, <br />Omaha District, completed in December, 1972, a floodplain informa- <br />tion report entitled "Special Flood Hazard Information Report, <br />Bear Creek, Denver Metropolitan Area"; and <br /> <br />~REAS, the Colorado Water Conservation Board, by <br />resolution adopted January 18, 1973, approved and designated the <br />floodplains described in the December, 1972, report: and <br /> <br />WHEREAS, a new report entitled "Flood Hazard Area <br />Delineation, Bear Creek," dated December, 1979, has been prepared <br />by Gingery Associates, rnc., at the request of the Urban Drainage <br />and FloOd Control District, the city and County of Denver, the city <br />of Lakewood, the city of Sheridan, and Jefferson County; and <br /> <br />WHEREAS, Bear Creek Dam and Lake is now fully operational <br />and said new report shows the residual 100-year (intermediate <br />regional flood) floodplain; and <br /> <br />WHEREAS, said report describes and outlines the flOOdplain <br />data and information for the storm and floodwater runoff channels <br />or basins of the study area: and <br /> <br />WHEREAS, the Urban Drainage and Flood Control District <br />has requested the Colorado Water Conservation Board to designate <br />and approve the floodplain areas as set forth in the aforesaid <br />report; and <br /> <br />'WHEREAS, Section 37-60-106(1), Colorado Revised statutes <br />1973, requires the Colorado Water Conservation Board to assist in <br />the prevention of flOOds and flood damages therefrom; and <br /> <br />~~EAS, Sections 31-23-201 and 30-28-111, Colorado <br />Revised Statutes 1973, provide that such legislative bodies of <br />local jurisdictions may provide zoning regulations for land uses <br />on or along any storm or floodwater runoff channel or basin only <br />after designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-106(1) (c), Colorado Revised <br />Statutes 1973, directs the Colorado Water Conservation Board to <br />designate and approve storm or floodwater runoff channels Or basins <br />and to make such designations available to legislative bodies of <br />lOcal jurisdictions; and <br />
