N <br /> <br />WHEREAS, the united States Army Corps of Engineers,Omaha <br />District, completed'floodplain'inforniation reports entitled "Flood <br />Plain Information, Volume II, Boulder Metropolitan Region" dated <br />August, 1969, and "Sr,ecial Flood Hazard Information Report, city <br />of Boulder, Colorado' dated May, 1972, which includes Boulder Creek; <br />and ' '-- . . . .,' , <br /> <br />WHEREAS, the Colorado Water Conservation Board, at the <br />request of the Denver Regional Council of Governments and the City <br />of Boulder, by resolutions adopted April 1, 1970 and August 16, <br />1972, approved'and designatedthe'f1oodplains described in said <br />reports; and <br /> <br />WHEREAS, a report entitled "Flood Insurance Study, City <br />of Boulder, Colorado," which includes floodplain information and <br />data for Boulder Creek, dated January, 1978, has been prepared by <br />Dames and Moore under contract with the Federal Insurance Admini- <br />stration; and <br /> <br />WHEREAS, said report describes and outlines the floodplain <br />data and information for the storm and floodwater runoff channels <br />or basins of the study area; and <br /> <br />WHEREAS, the City of Boulder has requested-the Colorado <br />Water Conservation Board to designate and approve the floodplain <br />areas as set forth in the aforesaid report; and <br /> <br />WHEREAS, Section 37~60-l06(1), Colorado Revised Statutes <br />1973, requires the Colorado Water Conservation Board to assist in <br />the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-201 and 30-28-111, Colorado <br />Revised statutes 1973, provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after <br />designation and approval by the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1) (c), Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate and <br />approve storm or floodwater runoff channels or basins and to make <br />such designations available to legislative bodies of local juris- <br />dictions; and <br />
