In addition, at the November 21, 2001 Board Meeting, the Board <br />adopted the "Easement Guidelines for the Chatfield Downstream Channel Improvement Project" dated <br />November 2001. The Staff has received a request from Semper Development Ltd. of Minneapolis, <br />Minnesota dated November 24, 2003. Semper Development Ltd. has submitted a complete CWCB <br />easement application. This request, if approved, will provide Semper Development Ltd. 821 Marquette <br />Avenue South, Suite 600, Minneapolis, Minnesota, 55042 the ability to construct a 6-foot wide <br />sidewalk across CWCB right-of-way for a connection to the Mary Carter Greenway Trail system. This <br />sidewalk connection is a requirement by the City of Littleton, Colorado in the Semper Development <br />site/construction permit. The proposed site is north of West Belleview Avenue, on the left overbank, <br />on the South Platte River floodplain and outside of the limits of the 100- year floodplain. <br /> <br />Discussion <br />Semper Development Ltd. has requested a sidewalk (path) easement for a permanent access to the <br />South Platte River Trail (Mary Carter) System. This sidewalk is a project feature for the Semper <br />Development Project, which is the construction of a Walgreen Complex. During the City of Littleton <br />site and project permit review of the development proposal; the sidewalk (path) access was a <br />requirement by the City. The development does not impact any of the CWCB, Corps of Engineers, and <br />South Suburban Parks and Recreation District's recreational and other channel project features. The <br />Semper Development sidewalk project is in the CWCB right-of-way limits. CWCB staff conducted a <br />field inspection of the Semper Development Ltd. request on December 2, 2003. <br /> <br />Use for the Requested Area <br />The use for the CWCB land is for the construction of a 6- foot sidewalk project, which is located in left <br />overbank the South Platte River Floodplain. The project is a sidewalk connection to the Mary Carter <br />Trail system for the general public access to the proposal Walgreen Development Project. The <br />easement area is 6 foot wide by 63 feet long more or less. (See attached map). The proposed project will <br />be designed and constructed by Semper Development Ltd. The staff finds that the proposed use will <br />work in harmony within the CWCB project right-of-way with certain subordination requirements stated <br />in the easement agreement. <br /> <br />Flood Protection.
