The Board Staff has spoken with the Applicant several times. As a result of those discussions, the
Board Staff recommended that the Applicant acquire a more dependable source of augmentation
water to assure 100% protection of the Board's Blue River rights. In particular, the Staff has
recommended that the Applicant pursue acquisition of suitable augmentation water from either the
Sunnnit County Small Users Pool or from the Vidler Water Company. You may recall that the
Board exempted the Blue River from de minimis in the Blue River agreements because the Blue
River Agreements subordinated the Board's rights to uses made pursuant to the Summit County
Small Users pool and the Vidler Water Company pool. The Staff recommendation would have
provided augmentation credits from these user pools, while not increasing the total amount of
consumptive uses to which the Board took subject on the Blue River system. However, the
